Terms of Service

These terms ("Terms") govern your use of ForgeFit ("the app", "we", "us"), operated by Campbell Blair, sole trader, ABN 14 278 891 663, Australia. By creating an account or using the app you agree to these Terms. If you do not agree, do not use the app.

1. The service

ForgeFit is a workout logger and AI-assisted training planner. Features include exercise logging, training plans and templates, progress tracking, body measurements and progress photos, achievements and ranks, Apple Health–based recovery insights, AI-generated workout suggestions and coaching, programme critique, and optional social features.

We may add, change or remove features at any time. Where a change materially reduces functionality you rely on, we will give reasonable notice.

2. Your account

• You must be 16 or older to use ForgeFit.
• You are responsible for keeping your password secure and for activity under your account.
• The information you provide must be accurate. You can update it in Settings → Profile.
• One account per person. Do not share login credentials.
• You may use guest mode without registering. Guest accounts are tied to a single device, if you lose or reset the device without registering, that data cannot be recovered.

3. Subscriptions and payments

• ForgeFit V1 is free. All current features are available at no cost and no subscription is currently sold.
• Some features may require a paid subscription in future. If subscriptions launch, iOS purchases are billed through Apple's In-App Purchase and managed by Apple; any web purchases are billed through Stripe. We never see or store your card details.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. iOS subscriptions are managed and cancelled in your Apple ID settings; we cannot cancel or refund an App Store subscription on your behalf.
• Cancelling stops the next renewal: it does not refund the period you are currently in. Refunds for App Store purchases are handled by Apple under Apple's policies.
• We will give at least 30 days' notice of any price change. Price changes never apply retroactively to a period you have already paid for.
• Prices are shown in your local currency where Apple supports it. Local taxes (GST, VAT, sales tax) may apply and are handled by the payment processor.

4. AI-generated content

ForgeFit uses third-party AI models: currently Anthropic's Claude for coaching, plans and critique, and Google's Gemini for image generation, to produce workout plans, coaching responses, progression suggestions and share images.

AI output is generated automatically and may contain mistakes. It is not medical, fitness, or professional advice. You are responsible for deciding whether any AI suggestion is safe and appropriate for you. If you have an injury or medical condition, or are unsure, consult a qualified coach or healthcare professional before acting on AI output.

You retain ownership of the content you submit to AI features. You are responsible for having the right to submit it, for example, do not upload a coaching programme you are contractually forbidden from sharing.

5. Apple Health

If you connect Apple Health, ForgeFit reads a limited set of metrics (heart rate, HRV, resting heart rate, sleep, steps, active energy) only to show you your recovery and readiness and to scale AI suggestions. We never write to your Health record, never use Health data for advertising, and never sell or share it. You can revoke access at any time in iOS Settings. See the Privacy Policy for full detail.

6. User content and community

ForgeFit includes optional social features that let you choose a username, connect with friends, share workouts, and post comments. If you use them, this section applies.

Your responsibilities

• You are solely responsible for the content you post, and you must have the right to post it.
• You must not post content that is unlawful, harassing, abusive, threatening, hateful, defamatory, sexually explicit, violent, or that promotes self-harm, disordered eating, or unsafe use of drugs or performance-enhancing substances.
• You must not impersonate anyone, post another person's private information, or post spam or commercial solicitation.
• The full standard is set out in our Community Guidelines, which form part of these Terms.

Reporting, blocking and enforcement

• Every post, comment and profile can be reported from inside the app, or by emailing safety@forgefit.fitness.
• You can block any user, which prevents them contacting you, seeing your activity, or interacting with your content.
• We review reports of objectionable content and act on them as quickly as possible, and generally within 72 hours: removing the content and, where warranted, suspending or permanently ejecting the user responsible.
• We may remove content or suspend accounts without prior notice where content is clearly unlawful or presents a risk of harm.

Our licence to your content

You keep ownership of everything you post. By posting content to a social feature, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely to operate the service: showing it to the people you shared it with, syncing it across your devices, and moderating it. This licence ends when you delete the content or your account, except for copies we must retain to resolve an open abuse report or meet a legal obligation.

We claim no ownership of your workouts, photos or notes, and we do not use your content for marketing without asking you first.

7. Acceptable use

You agree not to:

• Use the app for anything illegal.
• Reverse-engineer, decompile, scrape, or attempt to extract data from the app or our servers, except where the law expressly permits it.
• Use automated systems to create accounts, generate AI requests at scale, or otherwise place unreasonable load on the service.
• Use prompt injection or similar techniques to manipulate the AI into producing harmful, deceptive or off-policy output.
• Circumvent rate limits, entitlement checks, or any access control.
• Interfere with the app's operation, introduce malware, or attempt to overwhelm our servers.
• Resell, sublicense or commercialise access to ForgeFit without our written permission.
• Harass, stalk or abuse other users, or evade a block or ban.

8. Intellectual property

We own the ForgeFit name, logo, app code, exercise library content, rank and trophy artwork, and all other content we produce. Subject to these Terms, we grant you a personal, non-transferable, non-exclusive licence to use the app.

You own the workout data, photos and notes you log. By using the app you grant us a limited licence to store and process your content as needed to operate the service: syncing across devices, generating AI suggestions, and calculating your statistics. We claim no other rights to your data.

If you believe content on ForgeFit infringes your copyright, email safety@forgefit.fitness with a description of the work, where the infringing content appears, and your contact details. We remove infringing content promptly and terminate repeat infringers.

10. Termination

• You can delete your account at any time from Settings → Delete Account. This permanently deletes your account and all associated data.
• We may suspend or terminate accounts that breach these Terms or the Community Guidelines, or where required by law. Where reasonable and safe to do so, we will give notice and an opportunity to fix the problem, but breaches involving abuse, illegal content or risk of harm may result in immediate termination.
• Sections 4 (AI), 6 (licence to content), 8 (IP), 9 (Health), 11 (Disclaimer), 12 (Liability) and 15 (Governing law) survive termination.

11. Disclaimer

ForgeFit is provided "as is" and "as available". To the maximum extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the app will be uninterrupted or error-free, that data will never be lost, or that AI output will be correct.

12. Limitation of liability

To the maximum extent the law allows, our total aggregate liability to you for any claim relating to ForgeFit is limited to the greater of the amount you paid us in the 12 months before the claim arose, or AUD $100.

We are not liable for indirect, incidental, special or consequential damages, or for loss of profit, data or goodwill. Some jurisdictions do not allow these limits, in those places our liability is limited to the maximum extent the law allows, and the consumer guarantees described in Section 11 continue to apply.

13. Apple App Store terms

Where you obtained ForgeFit through the Apple App Store, the following apply and prevail over any inconsistent term:

• Apple is not a party. These Terms are between you and Campbell Blair only, not with Apple. Apple is not responsible for ForgeFit or its content.
• Scope of licence. Your licence to use ForgeFit is limited to a non-transferable licence to use it on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
• Maintenance and support. We are solely responsible for providing support for ForgeFit. Apple has no obligation to furnish any maintenance or support services.
• Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If ForgeFit fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation whatsoever.
• Product claims. We, not Apple, are responsible for addressing any claims relating to ForgeFit, including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
• Intellectual property claims. We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that ForgeFit infringes that third party's intellectual property rights.
• Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you in the app or by email and update the "Last updated" date above. Continued use after the changes take effect means you accept the updated Terms. If you do not accept them, delete your account.

15. Governing law

These Terms are governed by the laws of Victoria, Australia. Disputes will be handled by the courts of Victoria, Australia, unless mandatory consumer law in your country of residence gives you the right to bring proceedings in a different forum, in which case that right is preserved.
